Notice is hereby given that public hearings will be held by the Midway City Council on Wednesday, 14 March 2018, 6:00 p.m., in the City Council Chambers, Midway Community Center, 160 West Main Street, Midway, Utah. Time will be allowed for public comment regarding the following items:

Remund Farms / Master Plan (Berg Engineering) – Discuss and possibly grant master plan approval for the Remund Farms PUD located at 200 East and 600 North (Zoning is R-1-15). Recommended with Conditions by the Midway City Planning Commission.

Remund Farms, Phase I / Preliminary Approval (Berg Engineering) – Discuss and possibly grant preliminary approval for the Remund Farms PUD, Phase I located at 200 East and 600 North (Zoning is R-1-15). Recommended with conditions by the Midway City Planning Commission.

Lucerne Estates / Preliminary Approval (Berg Engineering) – Discuss and possibly grant preliminary approval for the Lucerne Estates Subdivision located at approximately 100 South and 100 East (Zoning is R-1-9). Recommended without conditions by the Midway City Planning Commission.

Pine Canyon Paradise / Preliminary and Final Approval (Summit Engineering) – Discuss and possibly grant preliminary and final approval for the Pine Canyon Paradise Subdivision located at 521 North Pine Canyon Road (Zoning is R-1-15). Recommended with conditions by the Midway City Planning Commission.

Ordinance 2018-11 / Parking Requirements in Commercial Zones – Discuss and possibly adopt Ordinance 2018-11 amending Title 16 of the Midway City Municipal Code regarding parking requirements in the C-2 and C-3 zones. Recommended without conditions by the Midway City Planning Commission.

Whitaker Farm / Master Plan (Luster Development) – Discuss and possibly grant master plan approval for the Whitaker Farm Subdivision located at 455 North River Road (Zoning is RA-1-43). Recommended without conditions by the Midway City Planning Commission.

MIDWAY CITY

NOTICE OF PENDING ORIDINANCES

Notice is hereby given by Midway City, Utah, that proposed ordinances are currently pending and under consideration by the Midway City Council and/or the Midway City Planning Commission for the following:

1. An Ordinance amending the density allowed in PUDs in the RA-1-43 Zone.

2. An Ordinance amending the proportion size lot and frontage requirements when open space is required.

3. An Ordinance increasing the setback requirements along collector roads.

4. An Ordinance amending open space requirements, density credit for additional open space provided open space is located on the periphery of the development.

Copies of the proposed Ordinances are available in the Midway City Offices during normal business hours. ALL FUTURE APPLICATIONS FOR DEVELOPMENT APPROVAL WILL BE SUBJECT TO THE TERMS OF ANY AMENDMENTS TO THE CURRENT PROVISIONS OF THE MIDWAY CITY CODE. All applicants are hereby notified that the acceptance for filing and processing of any applications for development approval by Midway City will not create any vested rights, equitable issues or legal claims against Midway City. MIDWAY CITY

NOTICE OF PENDING ORIDINANCES

Notice is hereby given by Midway City, Utah, that proposed ordinances are currently pending and under consideration by the Midway City Council and/or the Midway City Planning Commission for the following:

1. Midway City is proposing a Code Text Amendment of Midway City’s Land Use Code of Section 16.16.8 that would reduce densities in Planned Unit Developments from 1.5 units per acre to 1.25 units per acre.

2. Midway City is proposing a Code Text Amendment of Midway City’s Land Use Code that would amend the frontage and acreage requirements as related to open space for large-scale subdivisions located in Sections 16.16.12 of the Land Use Code. Standard subdivisions next to collector roads would require a 100’ setback but would still be allowed proportional reductions of frontage and area. Standard subdivisions not fronting a collector roads would no longer be allowed to reduce frontage and acreage for the first 15% based on the required open unless providing more than 15% open space.

3. Midway City is proposing a Code Text Amendment of Midway City’s Land Use Code that would increase the requirements for setbacks of planned unit developments and large-scale subdivisions located in Sections 16.16.8, 16.16.9, 16.16.10 and 16.17.7 of the Land Use Code. Setbacks for planned unit developments would increase from 100’ to 120’. Setbacks for standard subdivisions would increase from 30’ to 100’ along specified roads. Open space will be required to be located next to the collector roads. Also, sight obtrusive fencing will not be allowed in open space areas.

4. Midway City is proposing a Code Text Amendment of Midway City’s Land Use Code of Sections 16.16.11 and 16.16.12 that would amend open space requirements for large-scale standard subdivisions. The amendment would allow additional proportional reduction of frontage and acreage per lot if a subdivision provides more open space than the required 15.

Copies of the proposed Ordinances are available in the Midway City Offices during normal business hours. ALL FUTURE APPLICATIONS FOR DEVELOPMENT APPROVAL WILL BE SUBJECT TO THE TERMS OF ANY AMENDMENTS TO THE CURRENT PROVISIONS OF THE MIDWAY CITY CODE. MIDWAY CITY

NOTICE OF PENDING ORIDINANCES

Notice is hereby given by Midway City, Utah, that proposed ordinances are currently pending and under consideration by the Midway City Council and/or the Midway City Planning Commission for the following:

  1. Midway City is proposing a Code Text Amendment of Midway City’s Land Use Code that would amend the water requirements for master plan projects located in Section 16.16.4. The City would require that the water rights for all phases of a project be tendered to the City when the master plan is approved.
  2. Midway City is proposing a Code Text Amendment of Midway City’s Land Use Code that would specifically state that uses not listed in the code are not allowed unless specifically stated. The amendments would be found in 16.5, 16.7, 16.8, 16.9, 16.10, 16.11, 16.12 of the City’s Land Use Code.
  3. Midway City is proposing a Code Text Amendment of Midway City’s Land Use Code that would define reasonable accommodation for residential facilities for the elderly, limiting the number of residents allowed at 16. The amendments would be found in Section 16.13 of the City’s Land Use Code.
