Notice is hereby given that a public hearing will be held by the Midway City Council on Tuesday, 17 December 2019, 6:00 p.m., in the City Council Chambers, Midway Community Center, 160 West Main Street, Midway, Utah. Time will be allowed for public comment regarding the following items:

Ordinance 2019-13 / Off-Street Parking and Loading (City Planner) – Discuss and possibly adopt Ordinance 2019-13 amending Section 16.13.39(A)(11) (Off-Street Parking and Loading) of the Midway City Municipal Code. Recommended for approval by the Midway City Planning Commission.

Annexation Notice

A petition has been filed proposing annexation of an area into Midway City. On 5 February 2019, the Midway City Council received notice of certification of the annexation petition, from the Midway City Recorder, pursuant to Utah Code Section 10-2-405(2)(c)(i). The area proposed for annexation is located on the northeast corner of the intersection of River Road and Dutch Canyon Road. The boundaries of the area proposed for annexation are defined in the following description:

BEGINNING AT A POINT WHICH IS NORTH 10.52 FEET AND EAST 2.69 FEET AND PROCEEDING 331.57 FEET NORTH 88°49'38" EAST FROM THE NORTHWEST CORNER OF SECTION 25, TOWNSHIP 3 SOUTH, RANGE 4 EAST, SALT LAKE BASE AND MERIDIAN.

THENCE NORTH 88°49'38" EAST 446.26 FEET; THENCE SOUTH 26°09'24" WEST 57.88 FEET; THENCE SOUTH 22°33'38" WEST 152.90 FEET; THENCE SOUTH 21°24'08" WEST 464.13 FEET; THENCE SOUTH 22°39'58" WEST 126.94 FEET; THENCE NORTH 63°45'29" WEST 28.04 FEET; FOLLOWING A CURVE WITH A RADIUS OF 120 FEET WITH A CHORD LENGTH OF 64.76 FEET AND A BEARING OF NORTH 48°06'12" WEST; THENCE NORTH 32°26'56" WEST 126.94 FEET; THENCE NORTH 28°19'05" WEST 430.34 FEET; THENCE NORTH 61°40'55" EAST 205.98 FEET; THENCE NORTH 126.32 FEET TO THE POINT OF BEGINNING.

Midway City may grant the petition for annexation and annex the area described in the petition unless by the end of business hours on 7 March 2019 a written protest to the petition is filed with the Wasatch County Boundary Commission at 25 North Main Street, Heber City, Utah 84032 by an entity authorized to file such a protest, and a copy of the protest is delivered to the Midway City Recorder at 75 North 100 West, Midway, Utah 84049.

Notice of Public Meeting

Notice is hereby given that the MIDWAY CITY PLANNING COMMISSION will hold their regular meeting on Tuesday December 10, 2019 at 6 p.m. in the Midway Community Center, located at 160 West Main Street, Midway, Utah, to consider the following items:

Berg Engineering, agent for Watts Enterprises, is requesting Preliminary Approval for phases 2, 3A, 3B, and 3C of Watts Remund Farms Planned Unit Development. The proposal is for 58 single-family dwelling units located on 34.91 acres. The proposal is located at 200 East 600 North and is in the R-1-15 zone.

Berg Engineering, agent for Mountain Spa Investors LLC, is requesting a non-entitlement review of a concept plan for Mountain Spa which contains 156 units. The property is 78 acres and is located at 800 North and 200 East. The property is partially in the R-1-22 zone and partially in the Resort Zone.

Midway City is proposing a code text amendment of Section 16.2: Definitions. The proposed code will define One-Family Dwellings. Also, this proposal will define when a second kitchen is allowed in a one-family dwelling and will explain what constitutes a second kitchen. 

Midway City is proposing a code text amendment of Section 16.13.6: Accessory Buildings Prohibited as Living Quarters and Section 16.2: Definitions. The proposed code will better describe what is allowed in an accessory structure and define what is considered living quarters. The proposed amendment will also address breezeways and their relation to accessory structures.

Town Hall Meetings Regarding Transmission Line

Rocky Mountain Power Company and Heber Light & Power Company have requested a conditional use permit to upgrade an existing transmission line along 970 South, Stringtown Road and Wards Lane. 

Midway City will hold two town hall meetings to provide information and answer any questions regarding the request. The first meeting will be held on Thursday, 14 November 2019, 7:00 p.m. at the Old Town Hall, 120 West Main Street, Midway. A second meeting will be held on Saturday, 16 November 2019, 9:00 a.m. at the same location.
