Notice of Public Hearings

Notice is hereby given that public hearings will be held by the Midway City Council on Tuesday, 19 November 2019, 6:00 p.m., in the City Council Chambers, Midway Community Center, 160 West Main Street, Midway, Utah. Time will be allowed for public comment regarding the following items:

Burgi Hill Ranches PUD / Second Plat Amendment (City Planner) – Discuss and possibly approve a second amendment to the Burgi Hill Ranches PUD located at 290 East Saddle Drive.

Farm Springs Subdivision / Amendment (Summit Engineering) – Discuss and possibly amend the Farm Springs Subdivision located at 544 North Meriwether Way (Zoning is R-1-15). Recommended for approval without conditions by the Midway City Planning Commission.

Whitaker Farm Subdivision / Plat Amendment (Summit Engineering) – Discuss and possibly approve a plat map amendment for the Whitaker Farm Subdivision located at 455 North River Road.

Cascades at Soldier Hollow, Phase 2 / Plat Amendment (Summit Engineering) – Discuss and possibly approve a plat map amendment for Phase 2 of the Cascades at Soldier Hollow located at 500 West Cascade Parkway.

Rocky Mountain Power / Conditional Use Permit for Transmission Line (City Planner) – Discuss a conditional use permit for Rocky Mountain Power to improve a transmission line along 970 South, Stringtown Road and Wards Lane.

Ordinance 2019-12 / Land Use Map Amendment (City Planner) – Discuss and possibly adopt Ordinance 2019-12 amending the Midway City Land Use Map to include a portion of the Wasatch Mountain State Park. Recommended for approval by the Midway City Planning Commission.

Ordinance 2019-13 / Off-Street Parking and Loading (City Planner minutes) – Discuss and possibly adopt Ordinance 2019-13 amending Section 16.13.39(A)(11) (Off-Street Parking and Loading) of the Midway City Municipal Code. Recommended for approval by the Midway City Planning Commission.

Town Hall Meetings Regarding Transmission Line

Rocky Mountain Power Company and Heber Light & Power Company have requested a conditional use permit to upgrade an existing transmission line along 970 South, Stringtown Road and Wards Lane. 

Midway City will hold two town hall meetings to provide information and answer any questions regarding the request. The first meeting will be held on Thursday, 14 November 2019, 7:00 p.m. at the Old Town Hall, 120 West Main Street, Midway. A second meeting will be held on Saturday, 16 November 2019, 9:00 a.m. at the same location. 

Please attend one of the meetings regarding this very important issue.

 

Ordinance Adoption

The Midway City Council adopted the following ordinance on 3 September 2019:

  • Ordinance 2019-07 amending portions of Section 16.22 of the Midway City Code regarding small wireless communication facilities within the public right of way, and related matters.

Annexation Notice

A petition has been filed proposing annexation of an area into Midway City. On 5 February 2019, the Midway City Council received notice of certification of the annexation petition, from the Midway City Recorder, pursuant to Utah Code Section 10-2-405(2)(c)(i). The area proposed for annexation is located on the northeast corner of the intersection of River Road and Dutch Canyon Road. The boundaries of the area proposed for annexation are defined in the following description:

BEGINNING AT A POINT WHICH IS NORTH 10.52 FEET AND EAST 2.69 FEET AND PROCEEDING 331.57 FEET NORTH 88°49'38" EAST FROM THE NORTHWEST CORNER OF SECTION 25, TOWNSHIP 3 SOUTH, RANGE 4 EAST, SALT LAKE BASE AND MERIDIAN.

THENCE NORTH 88°49'38" EAST 446.26 FEET; THENCE SOUTH 26°09'24" WEST 57.88 FEET; THENCE SOUTH 22°33'38" WEST 152.90 FEET; THENCE SOUTH 21°24'08" WEST 464.13 FEET; THENCE SOUTH 22°39'58" WEST 126.94 FEET; THENCE NORTH 63°45'29" WEST 28.04 FEET; FOLLOWING A CURVE WITH A RADIUS OF 120 FEET WITH A CHORD LENGTH OF 64.76 FEET AND A BEARING OF NORTH 48°06'12" WEST; THENCE NORTH 32°26'56" WEST 126.94 FEET; THENCE NORTH 28°19'05" WEST 430.34 FEET; THENCE NORTH 61°40'55" EAST 205.98 FEET; THENCE NORTH 126.32 FEET TO THE POINT OF BEGINNING.

CONTAINING 5.629 ACRES.

The complete petition for annexation is available for inspection and copying at the office of the Midway City Recorder, 75 North 100 West, Midway, Utah 84049 or at www.midwaycityut.org/Recorders-Office. Midway City may grant the petition for annexation and annex the area described in the petition unless by the end of business hours on 7 March 2019 a written protest to the petition is filed with the Wasatch County Boundary Commission at 25 North Main Street, Heber City, Utah 84032 by an entity authorized to file such a protest, and a copy of the protest is delivered to the Midway City Recorder at 75 North 100 West, Midway, Utah 84049.
